Power of attorney for a remote sale
A valuation never needs a POA; a sale usually does. Here is how to execute one that sub-registrars and buyers accept.
- Draft a specific POA Name the property, the acts authorised (negotiate, sign agreement and sale deed, present for registration, receive consideration into your NRO account), and the holder (a relative you trust). Avoid general POAs; sub-registrars and buyers' lawyers reject them.
- Execute abroad Sign before the Indian consulate (attestation), or before a notary followed by apostille in Hague Convention countries.
- Send to India and adjudicate The holder presents the POA to the district collector or sub-registrar for stamp duty adjudication within three months of arrival in India; some states require registration of a POA that authorises sale.
- Use with the valuation and sale The valuer's report is in your name regardless; the POA holder signs the agreement and deed and coordinates inspection access.
- After the sale The holder deposits proceeds into your NRO account; the CA handles Forms 145/146; keep the POA for the bank's remittance file.
Frequently asked questions
Do I need a POA to get a valuation?
No. A valuation needs access and documents, not a signatory. A POA is only for signing sale documents.
Can the buyer's payment go to the POA holder?
It should go to your NRO account; TDS must be deducted in your name and PAN.
Is a POA signed in the US valid in India?
Yes if attested by the Indian consulate or notarised and apostilled, then adjudicated (and registered where the state requires) in India.
